These Terms of Service ("Terms") govern your access to and use of the website, products, services, communications, and other interactions provided by CONEX XPRESS, LLC, doing business as Conex Xpress ("Conex Xpress," "Company," "we," "us," or "our").

These Terms apply when you visit conexxpress.com, submit a contact or quote form, communicate with us, purchase or rent a container, enter into a rent-to-own arrangement, schedule a delivery, or otherwise use our services.

By using our website or services, you agree to these Terms. Separate quotes, invoices, purchase agreements, rental agreements, rent-to-own agreements, delivery agreements, warranties, or other written contracts may contain additional terms. If a separate written agreement conflicts with these Terms, the separate agreement will control with respect to that transaction.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use our services. By using the website or requesting services, you represent that the information you provide is accurate and that you have authority to act on behalf of yourself or the organization you represent.

2. Services

Conex Xpress provides shipping-container products and services that may include:

  • New or one-trip container sales
  • Cargo Worthy container sales
  • Wind and Water Tight container sales
  • Container rentals
  • Rent-to-own arrangements
  • Custom container modifications
  • Container delivery and on-site placement
  • Related consultation and customer-support services

Products and services are subject to inventory, availability, delivery area, site conditions, applicable law, and the terms of any separate written agreement.

3. Quote Requests

Submitting a quote request does not create a binding purchase, rental, delivery, or rent-to-own agreement.

To prepare an accurate quote, you agree to provide complete and accurate information concerning:

  • The requested container size and condition
  • The intended use of the container
  • The delivery address
  • Site access and placement requirements
  • Road, driveway, gate, utility, slope, clearance, and ground conditions
  • Any other facts reasonably relevant to delivery or placement

Quotes may be revised if information provided by the customer is incomplete or inaccurate, site conditions differ from those disclosed, inventory changes, or additional services are required.

4. Pricing and Orders

Pricing is subject to container availability, container condition, geographic location, transportation costs, delivery requirements, site access, customization, taxes, fees, and other transaction-specific considerations.

Unless expressly stated otherwise in writing:

  • A quote is an estimate and is not binding until accepted and confirmed by Conex Xpress
  • Inventory is not reserved until required documents and payments have been received
  • Prices may change before an order is confirmed
  • Applicable taxes, permit costs, site-preparation expenses, or third-party charges may be additional

Final pricing, payment requirements, and transaction terms will be stated in the applicable quote, invoice, or written agreement.

5. Container Condition and Availability

Containers may be described using industry condition classifications, including New or One-Trip, Cargo Worthy, and Wind and Water Tight.

Because many containers are used industrial products, cosmetic appearance may vary. Used containers may display dents, surface rust, patches, markings, repairs, fading, scratches, or other signs of prior use that do not necessarily impair the container's intended function.

Photographs shown on the website may be representative examples and may not depict the exact container delivered unless specifically stated in writing.

Container condition, specifications, and any applicable warranty will be governed by the customer's quote, invoice, inspection, or separate written agreement.

6. Delivery and Site Access

The customer is responsible for providing accurate delivery information and ensuring that the delivery site is safe, accessible, and suitable for the delivery vehicle and container placement.

The customer is responsible for:

  • Obtaining permission from the property owner when applicable
  • Obtaining required permits, approvals, or zoning authorization
  • Providing adequate road, gate, driveway, overhead, turning, and placement clearance
  • Identifying underground or overhead utilities, septic systems, drainage systems, and other hazards
  • Ensuring that the ground and placement surface can support the delivery equipment and container
  • Providing accurate information about slopes, soft ground, restricted access, and other site conditions

Conex Xpress or its delivery provider may postpone, modify, or refuse delivery when conditions are unsafe, inaccessible, unlawful, or materially different from those disclosed.

Additional charges may apply for failed delivery attempts, waiting time, redelivery, special equipment, restricted access, site-condition changes, or services not included in the original quote.

Delivery dates and time windows are estimates and may be affected by weather, traffic, equipment availability, transportation disruptions, mechanical issues, governmental restrictions, and circumstances beyond our reasonable control.

7. Payments, Rentals, and Rent-to-Own Arrangements

Payment amounts, due dates, deposits, financing terms, rental terms, late fees, cancellation provisions, ownership rights, and other transaction-specific requirements will be stated in the applicable invoice or separate written agreement.

Failure to make a required payment may result in suspension of service, cancellation, collection activity, repossession where legally permitted, or other remedies described in the applicable agreement or allowed by law.

How Customers Enroll

You may enroll by voluntarily entering your mobile number and affirmatively selecting an SMS consent checkbox on a Conex Xpress form, providing documented verbal consent, sending an authorized opt-in keyword, or completing another disclosed opt-in process.

Providing a telephone number by itself does not necessarily constitute consent to receive recurring SMS marketing messages. Marketing messages will be sent only when you have provided the required separate consent.

Message Types

Depending on the consent you provide, messages may include:

  • Quote confirmations and follow-ups
  • Responses to container inquiries
  • Container availability and pricing information
  • Order and account notifications
  • Delivery scheduling and status notifications
  • Customer-care communications
  • Occasional promotional messages when separately authorized

Message Frequency and Charges

Message frequency varies. Message and data rates may apply according to your wireless service plan. Consent to receive SMS or MMS messages is not a condition of purchasing goods or services.

Opting Out

You may opt out at any time by replying STOP to any Conex Xpress text message.

After replying STOP, you may receive one final message confirming that your opt-out request has been processed. After that confirmation, you will no longer receive SMS messages from that messaging program unless you opt in again.

Other recognized opt-out words may also be processed where supported by the messaging provider.

Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier availability, device compatibility, and network conditions.

Privacy

SMS communications are governed by our Privacy Policy. Mobile information will not be sold, rented, transferred, or shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with any third parties.

Changes to the Messaging Program

We may modify or discontinue a messaging program, change its content, or change its sending number when reasonably necessary. Material changes will be reflected in these Terms or otherwise communicated when required.

9. Telephone and Email Communications

When you provide your contact information, you authorize Conex Xpress to respond to your request by telephone or email. Promotional email or telephone communications will be made only as permitted by applicable law and any consent you have provided.

You may unsubscribe from marketing emails by using the unsubscribe link included in the email or by contacting us.

10. Acceptable Website Use

You agree not to:

  • Use the website for unlawful, fraudulent, abusive, or deceptive purposes
  • Submit false, misleading, or unauthorized information
  • Attempt to gain unauthorized access to the website, accounts, systems, or networks
  • Introduce malware, viruses, automated scraping tools, or harmful code
  • Interfere with the website's security, availability, or operation
  • Copy, reproduce, or exploit website content in violation of applicable law
  • Impersonate another person or organization

11. Intellectual Property

The Conex Xpress name, logos, website design, written content, photographs, graphics, service descriptions, and other website materials are owned by or licensed to Conex Xpress and are protected by applicable intellectual-property laws.

You may use the website for legitimate personal or business inquiries concerning Conex Xpress products and services. No ownership rights are transferred to you.

12. Third-Party Services and Links

Our website may contain links to third-party websites or use services provided by third parties, including payment processors, financing providers, delivery providers, mapping services, and technology platforms.

Conex Xpress does not control and is not responsible for the content, availability, security, privacy practices, or terms of independent third-party services.

13. Disclaimer of Warranties

Except for warranties expressly provided in a separate written agreement, the website and its content are provided on an "as is" and "as available" basis to the fullest extent permitted by law.

Conex Xpress does not warrant that the website will always be uninterrupted, error-free, secure, or free from harmful components. Website descriptions and general information do not replace the specifications or terms stated in a transaction-specific written agreement.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

14. Limitation of Liability

To the fullest extent permitted by law, Conex Xpress will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the website, communications, products, services, delivery delays, or these Terms.

Conex Xpress is not responsible for losses arising from:

  • Weather, traffic, transportation disruptions, governmental action, or events beyond our reasonable control
  • Inaccurate or incomplete information provided by the customer
  • Unsafe, undisclosed, inaccessible, or unsuitable site conditions
  • Customer failure to obtain permits or property authorization
  • Third-party websites or independent service providers
  • Normal cosmetic characteristics of used shipping containers

To the fullest extent permitted by law, Conex Xpress's aggregate liability for a transaction will not exceed the amount paid directly to Conex Xpress for the specific product or service giving rise to the claim.

Some jurisdictions do not allow certain liability limitations. In those jurisdictions, the limitations will apply only to the extent permitted by law.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Conex Xpress and its owners, officers, employees, representatives, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from:

  • Your violation of these Terms
  • Your unlawful or improper use of the website or services
  • False, incomplete, or inaccurate information you provide
  • Your failure to disclose delivery or placement hazards
  • Your violation of another person's rights

16. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.

Any dispute relating to these Terms or the website shall be brought in a court of competent jurisdiction located in Alabama, unless applicable law requires otherwise or the parties agree to another dispute-resolution process in writing.

We may update these Terms periodically. Updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of the website or services after updated Terms are posted constitutes acceptance of the revised Terms.

Changes to an existing purchase, rental, rent-to-own, or delivery agreement will be governed by that agreement and applicable law.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. The unenforceable provision will be interpreted or modified only to the minimum extent necessary to make it enforceable where permitted.

19. Entire Agreement

These Terms, the Privacy Policy, and any applicable quote, invoice, or separate written agreement constitute the agreement between you and Conex Xpress concerning the applicable website use or transaction.
