These Terms of Service (“Terms”) govern your use of services, communications, and interactions with CONTAINER SOLUTIONS AND STORAGE, LLC (“Company,” “we,” “our,” or “us”), an Alabama-based steel shipping container company providing container sales, rentals, rent-to-own, and delivery services throughout the Southeast.
By accessing our website at conexxpress.com, submitting a quote request, engaging with our chat features, or communicating with us via phone, email, or SMS, you agree to be bound by these Terms. You must be 18 years of age or older to use this SMS service.

1. SERVICES PROVIDED

Conex Xpress provides shipping container services including, but not limited to:
Container sales (New/One-Trip, Cargo Worthy, and Wind & Water Tight grades)
Container rentals and rent-to-own agreements
Custom container modifications
Delivery and professional on-site placement throughout the Southeast

All services are subject to availability, site conditions, container inventory, and separate written agreements where applicable.

2. COMMUNICATION CONSENT (SMS, EMAIL, PHONE)

By submitting your contact information to Conex Xpress, you expressly consent to receive communications from us, including but not limited to:

Phone calls
Text messages (SMS/MMS)
Emails

These communications may include:

Quote follow-ups and confirmations
Order and delivery updates
Scheduling and placement coordination
Customer service messages

Message frequency may vary.
Message and data rates may apply.
Consent to receive messages is not a condition of purchase.
Carriers are not liable for delayed or undelivered messages.

3. SMS OPT-OUT

You may opt out of SMS communications at any time by replying STOP to any message.
You may request assistance by replying HELP or contacting us directly.
Opting out will stop future SMS messages but will not affect existing service agreements.

4. NO SPAM / THIRD-PARTY SHARING

We do not sell, rent, or share your mobile number with third parties for marketing purposes.
Your contact information is used solely for legitimate business communications related to Conex Xpress.

5. ACCURACY OF INFORMATION

You agree to provide accurate and complete information when submitting quote requests or scheduling services. Providing false or misleading information — including inaccurate delivery addresses or site conditions — may result in delays, additional fees, or refusal of service.

6. QUOTES & PRICING

All quotes are:
All-inclusive, with delivery costs reflected in the quoted price
Non-binding until confirmed in a written or electronic agreement
Subject to change based on container availability, delivery distance, and site access conditions

Final pricing will be confirmed prior to order fulfillment.

7. CONTAINER CONDITIONS & GRADING

Containers are sold or rented according to the following grading standards:
New / One-Trip – 1–2 years old, like-new condition
Cargo Worthy (CW) – CSC-certified, structurally sound with minor cosmetic wear
Wind & Water Tight (WWT) – Fully functional with more visible weathering

Conex Xpress stands behind its grading standards. Customers in Alabama may visit our Harpersville showroom to inspect a container before purchase.

8. WARRANTIES & LIMITATIONS

Warranties on containers, if offered, will be outlined in a separate written agreement.
To the maximum extent permitted by Alabama law, Conex Xpress disclaims all implied warranties not expressly stated in writing.

9. LIMITATION OF LIABILITY

To the fullest extent allowed by law, Conex Xpress shall not be liable for:
Indirect, incidental, or consequential damages
Delays caused by weather, transportation disruptions, or acts of God
Site damage resulting from undisclosed or inaccessible delivery conditions
Issues arising from customer-provided inaccurate site or location information

Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.

10. INDEMNIFICATION

You agree to indemnify and hold harmless Conex Xpress from any claims, damages, or expenses arising from:
Your misuse of our services or delivered containers
False or inaccurate information you provide
Violation of these Terms

11. GOVERNING LAW

These Terms shall be governed and interpreted under the laws of the State of Alabama, without regard to conflict-of-law principles.

12. MODIFICATIONS

We reserve the right to update or modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the revised Terms.
